On this page “we”, “our”, “us”, and “Matalan” refers to Matalan Retail Limited. “the website” refers to matalan.co.uk. “You” means the person using the website or placing an order via it, or (where the person doing so is the employee, agent, or subcontractor of another person) the person on whose behalf the website is used or an order is placed.
2. Your use of this site is subject to these terms and conditions and to our Privacy Policy. If there is a conflict between these terms and conditions and the Privacy Policy, these terms and conditions take precedence.
3. We try to ensure the website is available at all times, but we do not guarantee this. For technical reasons, the website may be unavailable (in whole or in part) at some times, and we cannot guarantee that you will be advised of this in advance.
4. If you do not choose to create a password, we are unable to retain your details in a way which will allow you to retrieve them on later visits. If you do create a password, you are responsible for maintaining the security of your account and for taking steps to ensure that your password remains secure. We do not store your credit card details, other than limited information about your payment method which we need for legal compliance and administering your orders or account.

If you fail to provide complete and correct information, or fail to promptly update it when there are changes, this will be a breach of your agreement with us. We reserve the right to cancel any order and/or disable or delete any account where: we find that the information you have provided us is not complete, correct, and up to date; your account is used in connection with fraud, illegality, offensive or abusive conduct, the infringement of intellectual property rights, or to cause anxiety or annoyance to any person, or we reasonably suspect any of the foregoing or your involvement in them; we find that you received incomplete, or incorrect information before you placed your order.
6. We grant you a licence to access the website. This licence allows you to view the website, and use any content we may place on it from time to time. The licence does not allow you to download or save any part of the website (other than pages specifically designed to be printed or saved, or which you are expressly invited to print or save) except as this is necessary to allow you to view or use the website in the normal way. You may not edit, modify, reupload, or otherwise deal with any part of the website without our express prior written consent. We do not licence you to link to this website or any part of it. The licence we have given you does not allow you to do anything (including without limitation reproducing, copying, reselling, or otherwise exploiting) in connection with the website for the commercial benefit of any person other than companies in the Matalan Group. You are not permitted to collect, collate, index, or reproduce the website or any part of it (such as product listings) without our express prior written consent.
7. Our website is intended for use by adults, and to be a Matalan cardholder you must be over the age of 16. Use by persons under the age of 16 is not permitted unless with the involvement and supervision of a parent or guardian.
8. The products sold from this website are intended for private domestic use by consumers, and not for use by business entities.
9. The website is the property of Matalan Retail Limited. All of the content on the website (including graphics and text) is our property, and we assert our intellectual property rights in and to that content. That content is protected by UK, European, and International laws. The website makes use of trademarks owned by Matalan Retail Limited and other companies in the Matalan Group. These include, but are not limited to: MATALAN, EXPECT MORE, SOON, ET VOUS, PAPAYA, BE BEAU, and TAYLOR & WRIGHT. We also use trademarks which are licensed to us by their owners. You should not, and we do not licence you to, use any trademarks or trade dress which appear on this site.
10. When you place an order on the website, this is an offer by you to purchase a product or products from us. We will send you an email confirming we have received your order. This email is not an acceptance by us of your order, but merely an acknowledgement of it. We will only accept your offer to purchase goods, and thereby create a contract between you and us, when we send you an email confirming that we have dispatched your goods.
11. If the prices, descriptions, or any other information you have been provided with before placing your order is incorrect, we may cancel your order without liability to you.
12. You may return goods under the terms of our returns policy. Where you do so, you must abide by the terms of that policy. You may also use the statutory rights set out in the Distance Selling Regulations to cancel your contract with us. Further details of these rights may be found here .
13. We try to get product descriptions (both text and photographs) correct, and to ensure that product availability is accurate. However, product descriptions may change and availability may not be accurate. Where the description of a product changes, we will try to make you aware of this when you order, but you agree that we should send you the product which is in stock even if its description has changed. Where a product is not available, we will try to make you aware of this when you order, but you agree that we should send you any products from your order which are in stock even if one or more other products from your order is not.
14. By using the website, or sending email to us, you are using electronic communications. We will use electronic communications to provide you with information about the website, your account, and any orders you place. By using the website, you agree that we may provide you with information via electronic means, and agree that any contracts or other documents we need to provide you by law can be provided to you by electronic means.

We are not responsible for any losses you incur due to a breach by us of these terms and conditions, unless the loss you suffer was reasonably foreseeable to you and to us at the time the breach occurred (or, if earlier, the point at which we entered into a contract to sell you goods). We will not be responsible for any indirect or consequential loss.
16. We do not exclude or limit our liability in any way which is not permitted by law. If any part of these terms and conditions could be read as doing so, we and you agree that it should be read so as to insert or append a statement that the relevant exclusion or limitation does not exclude or limit our liability is excluded or limited where this is not permitted by law. This website is intended for use by consumers, and not for use by business entities. To the extent that you are a business entity and not a consumer we are entitled to limit our liability to you, and we do so by excluding all liability for any commercial losses you incur, excluding any liability for losses which arise in whole or in part from the fact that you are a business entity and not a consumer, and otherwise limiting our liability to the sum of £100 per order. If you choose to place an order you will be agreeing that such a limitation is reasonable.
17. We reserve the right to change these terms and conditions or our Privacy Policy at any time. The terms and conditions which apply to your use of the website will always be those current when you use the website. The terms and conditions which apply to an order will be those current when you placed your order. The Privacy Policy which applies to personal information will always be the one which applied when you provided the information, or the latest one which you agreed to.
18. If any of these terms and conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
19. Nothing in these terms and conditions affects or limits your statutory rights, except where this is permitted by law.
20. These terms and conditions are governed by and will construed in accordance with the laws of England. You and we agree to submit to the exclusive jurisdiction of the English Courts.

Household Energy Prize Draw
1. This promotion is only open to Matalan Reward Card holders who are UK residents aged 18 years and over, excluding employees of the Promoter, their relatives and anyone professionally connected with this promotion. This includes staff in store.
2. To enter shop and swipe your Matalan Reward Card at any participating Matalan store or online at www.matalan.co.uk between 05.01.12 and 26.02.12 to be automatically entered into the prize draw for the chance to win £1,200 towards their energy bills in 2012, £1,200 towards the energy bills of a nominated community organisation £1,200 and the opportunity to win £24,000 towards the energy bills of twenty friends and family.
3. All entrants will be entered into a prize draw on 02.03.12. Five names will be drawn at random by the Promoter’s Marketing Department. The five finalists will be contacted via telephone using the contact information provided in connection with the finalists Matalan Reward Card, each of the five finalists who will receive the following:
a. £1,200 towards their energy bills in 2012;
b. £1,200 towards the energy bills in 2012 of their nominated community project; and
c. A £600 Matalan shopping spree.
4. When each of the five winners are contacted to notify them of their win, each winner will be asked the tie break question ‘Tell us what you love about living in your community?’ and will be required to bring their written answer to the Promoter’s store when collecting their prize. The overall winner will be selected by the Promoter’s Marketing department based on the answers to the tie break question.
5. Each of the five winners and a representative from their selected community organisation will be invited into one of the Promoters store to receive their prize and take part in some associated publicity. [Whilst attending the Promoter store the five winners will be notified of the date when the overall winner will be announced. On that day members of the Promoter’s Marketing department will arrive at the overall winner’s door with a camera crew to confirm the overall winner and film the announcement.]
6. The overall winner will be asked to nominate twenty neighbourhood households to receive cheques for £1,200 towards their energy bills for 2012. The neighbourhood prizes will be given to the chosen households on [a date arranged between the overall winner, the Promoter and the winning households].
7. If a winner cannot be contacted within 14 days of the prize draw, or fail to respond and accept any prize within that time, they will be disqualified and a new winner will be drawn.
8. The overall winner, the four runners up, the representatives from the community organisations and all the neighbourhood households receiving a prize will be expected to participate in reasonable publicity related to the promotion. In addition to photographs appearing on the Promoter’s website, in local and national press and general marketing material of the Promoter, the five winners, community group representatives and the winning households will be asked to appear in live footage which may be shown on Twitter, Facebook , YouTube or similar.
9. The Promoter reserves the right to amend, alter or terminate this promotion at any time due to circumstances beyond its control.
10. If the Promoter discovers that any entrant was ineligible to enter or has breached these terms and conditions, that entrant will forfeit any prize won. If the Promoter discovers that a winner should not have been included, the prize winner will be disqualified, and a new winner will be selected.
11. The Promoter’s decision is final in connection with all matters arising from this promotion and no correspondence will be entered into.

NUS Online Discount
Matalan Reward Cardholders who also hold an NUS Card are eligible to receive a 10% discount off their Matalan purchases made online. To redeem the discount online please enter the exclusive NUS discount code (found on the NUS website) at check out along with your Matalan Reward Card number. The discount is not available on the purchase of gift vouchers, mobile phones, books, DVDs, electricals (except lighting) and cannot be used at Matalan Clearance Stores or in conjunction with High Street Vouchers (either in print or electronic format), Say shopping pass vouchers or any job centre/new deal vouchers. The NUS online discount cannot be used in conjunction with any other promotion, offer, discount, sale items or Matalan team member discount. Matalan reserve the right to amend or terminate this discount without notice. Matalan reserve the right to not accept codes that they deem invalid or fraudulent. Email Address Monthly Promotion
1. Matalan Reward Card holders who register their email address either in store or online at www.matalan.co.uk by completing the required form from 8th April 2010 will be automatically entered into a monthly draw to win £100 Matalan vouchers to use in store. The last draw will take place on 28th February 2011.
2. The Promoter reserves the right to vary the terms and conditions of the promotion at any time, or to withdraw the promotion altogether. There is no cash alternative to the prize offered. The Promoter reserves the right to substitute the prize for another which it considers equivalent where this is reasonably necessary.
3. Entry to the prize draw is open to Matalan Reward Card holders, excluding employees of the Promoter and their immediate family members. If the Promoter discovers that any entrant was ineligible to enter or has breached these terms and conditions, that entrant will forfeit any prize won. If the Promoter discovers that a winner should not have been included, that prize winner will be disqualified, and a new winner will be selected.
4. A prize winner will be drawn at random by the Promoter on the last day of every month and the winning Matalan Rewarded Cardholder will be informed, of their prize and how to claim the prize, using the contact details the Promoter has in relation to the winner's Matalan Reward Card account. The winner must respond within 28 days to receive his/her prize. If the winner does not respond in this time, the draw will be re-run.
5. Entries in respect of email addresses provided in one month will be entered into the draw for that month only and will not be carried over to the next month's draw.

Voucher card/code may be used an unlimited amount of times until the above end date by the named customer on the voucher. Blogger Style
1. The Promoter is running a competition for fashion bloggers. The Promoter will select four fashion bloggers every four weeks who will be asked to style one outfit in accordance with a given theme. The competition will run for a minimum of 4 months.
2. Each of the four fashion bloggers will be given a £50 voucher to spend at Matalan on clothing and accessories. The bloggers will then style the outfits and take one full length photograph of them wearing the outfit and upload that photograph to their own blog and provide the image to be uploaded to the Promoter’s blog.
3. The readers of the Promoter’s blog will then be asked to vote on their favourite outfit of the four submitted by naming their favourite in the comments field below the post. The winning outfit will be the outfit with the most votes at the end of each four week period.
4. This promotion is only open to anyone who has a UK based fashion blog that is updated on a regular basis and who the Promoter regards as a suitable stylist for the purposes of this competition. The fashion bloggers must be UK residents and aged 18 or over, excluding employees of the Promoter, their relatives and anyone professionally connected with this promotion. This includes staff in store.
5. The uploaded photo must be a full length picture showing the styled outfit with a file size of no larger than 2MB. The photo should show no-one other than the model, any photos showing other people will be automatically disqualified and removed from the Promoters blog.
6. The prize will consist of items or vouchers from Matalan or partners worth a minimum of £50.
7. If the winning blogger cannot be contacted with 14 days of the date when the Promoter’s first attempts to contact them to notify them of their prize and/or fails to claim their prize within that time, they will forfeight the right to claim the prize.
8. All fashion bloggers who enter into this competition may be expected to participate in reasonable publicity related to the promotion.
9. The winner of each monthly contest will be expected to upload an image provided by the Promoter to their own blog which illustrates they are a winner of the Matalan Style Project. They must display this publicly on their blog for a minimum of 1 month.
10. All fashion bloggers who enter this competition consent to the Promoter publishing their first name and photograph on the Promoter’s blog and website.
11. By having uploaded their photograph to the Promoter’s blog, entrants grant to the Promoter an irrevocable perpetual license to use any photographs uploaded to the Matalan blog in any of the Promoters publications and in any media now known or hereinafter invented, including the Promoter’s website. However, nothing herein shall oblige the Promoter to use any photographs of the entrants. Entrants’ moral rights are not affected.
12. The Promoter will not store the photographs of the entrants, for longer than is necessary for promotional purposes, in any event no longer than 12 months. After such time the photographs will be deleted.
13. None of the prizes cannot be transferred to another person or be exchanged.
Win £250 Matalan Vouchers
1. This promotion is only open to Matalan Reward Card holders, excluding employees of Matalan, their relatives and anyone professionally connected with this promotion. This includes staff in store.
2. To enter shop online at www.matalan.co.uk, write a review of any product purchased and if that review is published at www.matalan.co.uk between 01/06/11 and 30/06/11 you will be automatically entered into the prize draw.
3. There is one prize to be won each month:
Prize: £250 worth of Matalan vouchers. The winner can specify where they would like to redeem the vouchers either online or in store.
There is no cash alternative and the prize is non-refundable, non-exchangeable and non-transferable. If for any reason the prize becomes unavailable it will be replaced with an alternative of the same or higher value.

England Netball Prize Draw
1. Entrants to the Prize Draw must:
a. Be UK residents aged 16 years and over, excluding employees of Matalan, their relatives and anyone professionally connected with this promotion. This includes staff in store; and
b. Either:
- Be an existing “Matalan and England Netball Reward Card” holder who has registered their name and address with Matalan, in which case the Card holder will be entered into the competition automatically; or
- Apply for a “Matalan and England Netball Reward Card” before 20 January 2011. In order to qualify for a “Matalan and England Netball Reward Card”, the applicant must be a member of England Netball. 2. Holders of “Matalan and England Netball Reward Cards” who have not registered their name and address with Matalan can register their details so that they are entered into the prize draw by either attending any Matalan store or ringing Matalan’s customer services on 0845 330 3330.

4. One winner will be drawn at random on or before 17.02.12. If the winner cannot be contacted within 14 days of the prize draw, or fail to respond and accept any prize within that time, they will be disqualified and a new winner will be drawn.

All England Netball Matalan Reward Card Holders
The Matalan Card may only be used by the authorised signatory and is not transferable. Only those aged 16 or over may register for a Matalan Card. If you have lost or forgotten your Matalan Card, please ask at the Matalan store Customer Services who will be happy to help. Your Matalan Card is valid at any Matalan store throughout the UK. The Matalan Card is not a credit, debit or cheque guarantee card. Matalan returns and exchange policies apply as normal to all purchases made using your Matalan Card (see in store details). The Matalan Card remains the property of Matalan Retail Ltd (Gillibrands Road, Skelmersdale WN8 9TB Telephone 0845 3303330) which is responsible for providing the services to you. If your contact details change then you should notify us as soon as possible in order to continue to receive details of special offers and discounts that you are eligible for (see below for details).

Creating a Contract
The steps required to create a contract between you and Matalan:
1. You place an order for your products on the Matalan website by pressing the confirm order button at the end of the checkout process.
2. We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Matalan.co.uk.
3. When your product is shipped from our warehouse we will send you a despatch confirmation email.
4. Order acceptance and the completion of the contract between you and Matalan will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order.
The reasons for non-acceptance of an order by Matalan may be a result of one of the following:
1. The product you ordered being unavailable from stock; or
2. Our inability to obtain authorisation for your payment; or
3. The identification of a pricing or product description error.
PayPal Payments
PayPal orders will be treated as any other order, your PayPal account will be deducted when we receive your order. Any refunds can be taken back to store or sent to us by post. In both cases your PayPal account will be credited, cash and card refunds are not available on PayPal orders.
Refunds
Christmas 2011 returns
If you make a purchase between 1st October and 25th December you can simply return your goods with your receipt up until and including 31st January for a full refund or exchange.
Goods can either be returned to store or by post (see below). Please note that we do not offer an exchange service by post.
We reserve the right to refuse to exchange or refund items that are not returned within 28 days of delivery.
In order to qualify for our refunds policy, all Items must be in a re-saleable condition i.e. undamaged, in their original and undamaged packaging, unworn and complete with all tags and labels attached.
We reserve the right to refuse to refund items that are returned that are not in re-saleable condition. Goods returned in an unsatisfactory and not in a re-saleable condition may be returned to you at your expense.
Goods must be returned with your original receipt and be in the condition that they were purchased.
Without a receipt we will exchange or refund in vouchers at the last know selling price.
If you return a single item bought as part of a multi buy discount offer (for example buy 2 for £20.00) you will be refunded the full price of the item less any discount given in the offer. If you return all the items purchased with the multi buy offer discount you will refunded with the full multi-buy value.
If your payment card expires before we process your refund please contact customer services by telephone with your order number, postcode and new card details.

Exceptions to Refund Policy
There are exceptions to our Refunds policy for certain items. Please note this is a non-exhaustive list and that these conditions do not affect your non-excludable statutory rights.
For reasons of health, hygiene safety and copyright, we are unable to exchange or refund the following products once worn or once the packaging has been opened or damaged unless the items are of unsatisfactory quality or unfit for purpose:
• Pierced earrings;
• cosmetics/fragrances;
• hats;
• hair accessories;
• quilts;
• duvets;
• pillows;
• DVD’s (in original packaging with any security seals still intact)
• confectionery;
• underwear (unless the hygiene strips and tags are still in place);
• control wear;
• hosiery; and
• swimwear (unless the hygiene strips and tags are still in place).
Gift vouchers are non-refundable and cannot be exchanged for cash.

Your local store will be pleased to arrange an exchange or refund for you under our refunds policy.

The parcel should contain:
• The item(s) you purchased that you wish to return in their original condition.
• Your original delivery note with the returns section fully completed, clearly stating which item(s) you are returning and the reasons why you are returning the goods.
You will be refunded for the delivery charge if we have made an error in our despatch or if the item received is faulty or unfit for purpose, unless you have decided to keep part of the received order. We will also refund your delivery charge if you are an EU customer cancelling within 7 days of receiving of your order under the Distance Selling Regulations (see below).
We are unable to accept any responsibility for items that are lost and damaged in the post. You must ensure that your items are securely packaged, and obtain a proof of posting. Please allow at least two days for your goods to reach us.
Please note that we are not able to give exchanges for goods returned by post, and you should allow 28 days to receive your refund. Please safely dispose of any broken glass before returning an item to us.

Sale of Goods
Our refunds policy is in addition to your statutory rights.
Under the Sale of Goods Act, the goods we sell you must:
• conform to the description we have given you
• be of satisfactory quality.
• be fit for purpose.
• be safe.
You have statutory rights to have goods which do not meet these standards repaired or replaced, or in certain circumstances you can receive a refund.
Age Restrictions
Please note that certain items available on Matalan.co.uk are age restricted. Any items marked as 'Age Restricted Item. Please refer to Terms & Conditions*' are not for sale to people under the age of 18. By placing an order for these products, you declare that you are 18 years of age or older. These items must be used responsibly and appropriately.
Distance Selling Regulations
Our refunds policy is in addition to your statutory rights under the Distance Selling Regulations.
Under these regulations you have the right to cancel a contract for the sale of goods, where that contract has been entered by distance means (e.g. via website). The right to cancel does not apply to the following products for reasons of health and hygiene once the product has been worn or once the packaging has been opened or damaged; pierced earrings, cosmetics/fragrances, hats, hair accessories, quilts, duvets, pillows, confectionary, underwear (unless the hygiene strips and tags are still in place), control wear, hosiery and swimwear (unless the hygiene strips and tags are still in place).
If you want to cancel, you must do within seven working days after delivery of the goods.
To cancel the contract you must send us a written notice stating that you wish to cancel the contract. We will only be able to process your cancellation if we have your order number, so you should also enclose your delivery note.
You are responsible for returning the goods to us at your cost.

Where you cancel a contract, you have an obligation to keep possession of the goods and take reasonable care of them prior to returning them.
Once we have received your notice of cancellation we will arrange to reimburse you. It may take up to 30 days from the date we receive your cancellation notice for this to be done. We will only reimburse you to the card with which you paid.
