Matalan User Generated Content Terms and Conditions

By permitting Matalan Retail Limited and its group of companies (“Matalan”) to use

your images, photos, video and/or other online content (“Content”), you agree to be

bound by these Terms and Conditions.

By replying #yesMatalan to a request from Matalan (or from a third party acting on

Matalan’s behalf) to use your Content or by otherwise indicating your agreement for

Matalan to us or by otherwise indicating your agreement for Matalan to use your

Content, you agree to the following:

1. You irrevocably grant permission for your Content to be used by for commercial use

   in promotional material, in perpetuity and worldwide, in any and all media, including

   but not limited to print and digital brochures, retail store graphics, press articles, offline

   and online advertising, paid media, social media, print media, emails, websites, digital

   screens, internal and external events, film, video, cable and broadcast television and

   the Internet. Such rights also extend to Matalan ’s subsidiaries, affiliates, agents,

   employees, representatives, assigns, licensees, and anyone else acting on behalf of

   Matalan .

2. You agree Matalan does not have to credit your Content.

3. Matalan reserves the right, to edit, change or alter your Content as it deems

   necessary, without your approval.

4. You accept that there will be no form of payment made to you or to a third party, for

   the use of the Content.

5. By giving Matalan permission to use your Content, you represent and warrant to

   Matalan that:

   (a) you are the owner of the Content you have provided, including all ideas, images,

   text, and intellectual property rights within the Content, (including but not limited to,

   copyrights, trademark rights, patent rights, publicity rights) or if you are not the owner

   of such rights, you have already obtained permission from the owner of such rights

   and have the authority to grant Matalan permission to use the Content as provided in

   these Terms and Conditions;

   (b) Matalan’s use of your Content as provided herein will not infringe on the intellectual

   property rights, publicity rights, or data protection rights of any third party or require

   the payment of any compensation to any third party;

   (c) nothing in the Content you provided is likely to be considered illegal, defamatory,

   obscene, or threatening to any third party;

   (d) you are over the age of 18 and have the right to enter into this agreement in you

   own name; and

   (e). no children (individuals under the age of 16) appear in the Content, and that the

   Content does not depict, feature, or include children in any form. You further confirm

   that the Content does not contain or reveal any personal data relating to children,

   including but not limited to names, likenesses, voices, drawings, or any other

   information that could identify a child, whether directly or indirectly.

6. We ask that children (individuals under the age of 16) do not post or submit personal

   information or content through our social media channels. If we become aware that

   we have inadvertently collected personal information or content featuring a child, we

   will delete that information from our records.

7. You hereby hold harmless and indemnify Matalan from any claims related to

   Matalan’s use of the Content as permitted herein, whether in existence today or in the

   future, including, without limitation, all rights, demands and/or liabilities regarding

   breach of data protection rights, copyright infringement, violation of the rights of

   publicity and privacy, moral rights and/or breach of confidentiality. By replying

   #yesMatalan or by otherwise indicating your agreement for Matalan to use your

   Content you acknowledge and agree that you have read, understand, and agree to

   the above Terms and Conditions.

8. If you wish to withdraw permission to use your Content, please contact us at
